As of 2026, California operates a fully legal adult-use and medical cannabis market regulated by the Department of Cannabis Control (DCC). Adults 21+ may legally purchase, possess, and cultivate cannabis. California remains one of the most active cannabis regulatory environments in the nation, with over a dozen new bills introduced in the 2026 legislative session.

Adults 21+ may legally possess up to 1 ounce (28.5g) of cannabis flower and up to 8 grams of concentrate. Medical patients may possess up to 8 ounces of flower or more if deemed medically necessary by a physician. Possession over the legal limit is a misdemeanor punishable by up to 6 months in county jail and/or a $500 fine.

 California provides strong employment protections for off-duty cannabis use. As of January 2024, employers may not discriminate against employees or applicants for off-the-clock cannabis use. Pre-employment urine and hair tests for cannabis are prohibited for most employers. Employers may still test for on-the-job impairment, and exemptions exist for construction workers and federal contractors.

USAGE

Where You Can Use It

Cannabis consumption is permitted in private residences and at licensed on-site consumption lounges. As of 2025, licensed lounges may sell non-infused food, non-alcoholic beverages, and host ticketed events. Public consumption — including streets, parks, restaurants, and vehicles — is strictly prohibited. Local jurisdictions control whether consumption lounges are permitted in their area.

DRIVING

Driving

Driving under the influence of cannabis is illegal in California. There is no established per se THC blood limit — impairment is determined by officer observation, field sobriety testing, and Drug Recognition Expert evaluation. Penalties mirror alcohol DUI consequences including fines, license suspension, and potential jail time. A first offense DUI carries up to 6 months in jail and a 6-month license suspension.

TRAVELING

Traveling

Cannabis may be transported within California in a sealed container in the trunk or locked glove box. Crossing state lines with cannabis is federally illegal regardless of destination. Taking cannabis through LAX, SFO, or any California airport is prohibited — TSA operates under federal jurisdiction and will refer violations to law enforcement.

Enforcement and Compliance

The California Department of Cannabis Control (DCC) oversees all licensing, enforcement, and regulatory compliance statewide. All licensed businesses must comply with seed-to-sale tracking via Metrc, rigorous laboratory testing standards, and strict packaging and labeling requirements. The DCC actively pursues unlicensed operators — illegal cultivation of more than 6 plants causing environmental harm is a felony under SB 753.

2026 Legislative Status

As of June 2026, over a dozen cannabis and hemp bills are active in the California legislative session. Key updates include DCC rulemaking on multipack cannabis goods (DCC-2026-01-R), extended cannabis event licenses up to 30 days, and AB 8 (signed 2025) integrating hemp-derived products into the regulatory framework. California's 19% cannabis excise tax remains in effect on all retail sales.

Adults 21+ may grow up to 6 cannabis plants per residence for personal use. The 6-plant limit applies per household regardless of the number of adults.
