Possession

Any possession of cannabis in Iowa outside of the extremely limited CBD program is a criminal offense. First offense possession of any amount is a serious misdemeanor carrying up to 6 months in jail and a $1,000 fine. A second offense elevates to a serious misdemeanor with enhanced penalties. Third and subsequent offenses are aggravated misdemeanors. There are no decriminalization provisions and no adult-use exemptions anywhere in Iowa.

Your Job

Iowa provides zero employment protections for cannabis users including registered medical cannabidiol patients. Employers may test, discipline, and terminate employees for any positive cannabis result. The state's medical cannabidiol program explicitly does not require employers to accommodate patient use in any workplace setting. Out-of-state medical cards carry no legal recognition or protection in Iowa whatsoever.

USAGE

Where You Can Use It

There is no legal location to consume traditional cannabis anywhere in Iowa. Registered medical cannabidiol patients may only use state-approved CBD products with up to 3% THC in private residences. No dispensaries offering flower exist. No consumption establishments are permitted. Public consumption of any cannabis product carries criminal penalties under Iowa Code § 124.

Driving

Driving under the influence of cannabis is illegal in Iowa. Iowa enforces a zero-tolerance per se standard — any detectable amount of THC or its metabolites in your system while operating a vehicle is prosecutable as an OWI. A first offense OWI carries fines up to $1,250, license revocation, and up to 1 year in jail. Iowa law enforcement uses field sobriety testing and urine or blood testing to establish impairment.

TRAVELING

Traveling

Iowa borders Illinois and Minnesota — both legal adult-use states. Transporting any amount of cannabis across these borders into Iowa is a state and federal felony regardless of where it was legally purchased. Medical cannabidiol patients may only use state-issued Iowa CBD products and may not import cannabis products from other states. Law enforcement actively patrols border corridors from neighboring legal states.

Enforcement and Compliance

Iowa law enforcement enforces all cannabis statutes under Iowa Code § 124 with no exceptions for out-of-state patient status or medical necessity outside the state's narrow cannabidiol program. The Iowa Department of Public Health administers the medical cannabidiol registry and oversees the five licensed dispensaries authorized to dispense CBD-only products to registered patients. Penalties escalate with each subsequent offense and Iowa maintains no expungement pathway specific to cannabis convictions.

2026 Legislative Status

As of June 2026, Iowa continues to operate under one of the most restrictive cannabis frameworks in the Midwest. The medical cannabidiol program allows only CBD products with up to 3% THC for a narrow list of qualifying conditions. Multiple bills to expand the medical program to include flower and higher THC products have been introduced and failed in recent sessions. SF 2340 proposed broader medical access in 2025 but did not advance. No recreational legalization effort has come close to a floor vote and no major reform is anticipated before 2027.

PROHIBITED

Home cultivation of cannabis is a felony in Iowa regardless of quantity or purpose. Growing even a single plant is prosecuted under Iowa Code § 124.401 and carries significant jail time and fines. Registered medical cannabidiol patients have no home cultivation rights — all CBD products must be obtained exclusively through one of Iowa's five state-licensed dispensaries.

Out-of-State Reciprocity

Iowa does not recognize medical cannabis cards issued by any other U.S. state or territory. Out-of-state patients have zero legal protection in Iowa and are subject to the same criminal penalties as any Iowa resident.
