Kansas maintains a complete prohibition on cannabis in all forms as of 2026. There is no medical program, no decriminalization, and no recreational framework of any kind. Kansas is one of only three remaining states — alongside Idaho and South Carolina — with absolutely no cannabis access pathway for residents. All possession, use, cultivation, and distribution is a criminal offense under the Kansas Uniform Controlled Substances Act.

STATE LAW GUIDE

Kansas Cannabis Laws 2026

FULLY ILLEGAL

Is Weed Legal in Kansas?

CRIMINAL

Possession

Any amount of cannabis possession in Kansas is a criminal offense with no exceptions. First offense possession of any amount is a Class B nonperson misdemeanor carrying up to 6 months in jail and a $1,000 fine. A second offense is a Class A nonperson misdemeanor with up to 1 year in jail. A third or subsequent offense elevates to a drug severity level 5 felony. Kansas has no decriminalization provisions and no medical exemptions of any kind.

EMPLOYMENT

Your Job

Kansas provides zero employment protections for cannabis users of any kind. Employers may test, discipline, and terminate employees for any positive cannabis result including legal out-of-state medical use. No state law restricts an employer's right to enforce a zero-tolerance drug-free workplace policy. Out-of-state medical cards carry absolutely no legal recognition or protection in Kansas.

USAGE

Where You Can Use It

There is no legal location to consume cannabis anywhere in Kansas — public or private. No dispensaries exist, no consumption establishments are permitted, and private residential use carries the same criminal penalties as public consumption. Hemp-derived CBD products must contain 0.0% THC to be considered legal in Kansas — even trace amounts carry significant legal risk under state law

DRIVING

Driving

Driving under the influence of cannabis is illegal in Kansas. The state enforces a per se limit of 5 nanograms of THC per milliliter of blood. A first DUI offense carries fines up to $1,750, license suspension of 30 days to 1 year, and up to 6 months in jail. Kansas law enforcement uses field sobriety testing and blood draws to establish impairment. Any open cannabis in a vehicle is a separate criminal offense.

TRAVELING

Traveling

Kansas borders Colorado and Missouri — both legal adult-use states. Transporting any amount of cannabis across these borders into Kansas is a state and federal felony regardless of where it was legally purchased. Law enforcement actively monitors Interstate 70 and other major corridors entering from Colorado and Missouri. Out-of-state medical cards provide zero protection in Kansas under any circumstances.

Enforcement and Compliance

Kansas law enforcement maintains aggressive enforcement of all cannabis statutes under the Kansas Uniform Controlled Substances Act with no exceptions for medical necessity or out-of-state authorization. Penalties escalate sharply with each subsequent offense and quantities indicating distribution intent carry felony-level charges. Kansas Highway Patrol actively intercepts cannabis being transported from neighboring legal states Colorado and Missouri along Interstate 70 — one of the most heavily monitored cannabis trafficking corridors in the nation. Kansas has no expungement pathway specific to cannabis offenses.

2026 Legislative Status

As of June 2026, Kansas remains one of only three states in the nation with absolutely no cannabis program of any kind. Multiple medical cannabis bills have been introduced and failed in recent legislative sessions — most recently SB 135 which proposed a limited medical framework but failed to advance to a floor vote in 2025. The Kansas governor has previously expressed support for medical cannabis but the legislature has not moved meaningful reform forward. No recreational legalization effort has come close to a vote and no major reform is anticipated before the 2027 session.

PROHIBITED

Home cultivation of cannabis is a felony in Kansas regardless of quantity or stated purpose. Growing even a single plant is prosecuted under the Kansas Uniform Controlled Substances Act and carries significant jail time and fines. There are no medical exemptions, caregiver provisions, or personal use exceptions of any kind recognized under Kansas law.

Home Cultivation

ILLEGAL

Out-of-State Reciprocity

Kansas does not recognize medical cannabis cards issued by any other U.S. state or territory. Out-of-state patients have zero legal protection in Kansas and are subject to the same criminal penalties as any Kansas resident. There is no reciprocity program, no visitor card pathway, and no pending legislation that would establish any form of out-of-state recognition under Kansas law.
