Adult-use possession for non-registered individuals remains a criminal offense. Possession of 1 ounce or less is an infraction carrying a $300 fine for a first offense. Possession of more than 1 ounce is a misdemeanor carrying up to 3 months in jail. Possession of more than 1 pound is a felony.

Employers may maintain and enforce drug-free workplace policies and may discipline or terminate employees for positive cannabis results regardless of medical registration status. A first DUI offense carries fines of $500, license revocation of 6 months to 1 year, and up to 60 days in jail. Medical cannabis registration provides no protection against DUI charges in Nebraska.
TRAVELING
Traveling
Nebraska does not border any legal adult-use states but remains subject to federal law on all interstate travel. Transporting any amount of cannabis across state lines into or out of Nebraska is a federal felony regardless of medical status. Nebraska medical cannabis patients may not travel across state lines with their medicine once the program is operational. All medical cannabis must be sourced exclusively within Nebraska's licensed dispensary network.
Enforcement and Compliance
The Nebraska Medical Cannabis Commission is actively building the regulatory infrastructure for patient registration, caregiver certification, and dispensary licensing following the passage of LB 474 in 2024. Law enforcement continues to actively enforce all recreational cannabis statutes with no exceptions for medical necessity until the program is fully operational. Penalties escalate significantly based on quantity and intent — distribution and cultivation carry felony-level charges under Nebraska Revised Statutes § 28-416. Nebraska has no expungement pathway specific to cannabis convictions.
2026 Legislative Status
As of June 2026, Nebraska is in active implementation of its medical cannabis program following the historic passage of Initiative 437 by voters in November 2024. The Nebraska Medical Cannabis Commission is finalizing patient registration systems, dispensary licensing frameworks, and operational regulations. The first licensed dispensaries are expected to open in late 2026 or early 2027. Recreational legalization efforts have not advanced in the legislature and no adult-use bill has come close to a floor vote. Growing even a single plant remains a criminal offense carrying misdemeanor to felony charges depending on quantity under Nebraska law.
