Is Weed Legal in New York?
RECREATIONAL
New York legalized adult-use cannabis in March 2021 and began licensed retail sales in late 2022. Adults 21 and over may legally purchase and possess cannabis from licensed retailers statewide. The medical program continues alongside the adult-use market offering registered patients additional protections and tax exemptions. The New York Office of Cannabis Management oversees all licensing, compliance, and regulatory enforcement for both the medical and adult-use markets.
RECREATIONAL
Possession
Adults 21 and over may legally possess up to 3 ounces of cannabis flower and up to 24 grams of concentrate on their person. Up to 5 pounds may be stored in a private residence. Adults may cultivate up to 3 mature plants and 3 immature plants per person with a maximum of 6 mature plants per household for personal use. Possession above legal limits carries civil fines or criminal charges depending on quantity. Registered medical patients receive enhanced purchase limits and are exempt from state cannabis excise tax.
EMPLOYMENT

New York law provides some of the strongest employment protections for cannabis consumers in the nation. Employers may not discriminate against employees or applicants solely for legal off-duty cannabis use under the New York Labor Law § 201-D. Employers retain the right to prohibit on-duty use and act on reasonable suspicion of workplace impairment. Safety-sensitive positions and federally regulated employers are exempt. Employers may not require pre-employment cannabis drug testing in most circumstances.
USAGE
Where You Can Use It
Cannabis may be consumed anywhere tobacco smoking is permitted under New York law — including sidewalks and outdoor public spaces — unless otherwise prohibited by local ordinance. Consumption is prohibited in vehicles, workplaces, schools, and government buildings. Licensed cannabis consumption lounges are permitted under the Marijuana Regulation and Taxation Act. Landlords retain the right to prohibit smoking in rental units but may not prohibit other forms of consumption such as edibles or vaporizers.
DRIVING
Driving
Driving under the influence of cannabis is illegal in New York. The state uses an impairment-based DWAI standard — there is no established per se nanogram THC blood limit. Law enforcement uses field sobriety testing and blood draws to establish impairment. A first DWAI-Drug offense carries fines of $500–$1,000, license revocation of 6 months, and up to 1 year in jail. Open cannabis in a vehicle must be stored in a sealed container in the trunk or an area inaccessible to the driver and passengers.
TRAVELING
Traveling
Cannabis purchased legally in New York may not be transported across state lines regardless of the destination state's laws — interstate transport remains a federal offense. New York borders New Jersey and Connecticut — both legal adult-use states — but crossing state lines with cannabis remains federally prohibited regardless. Cannabis is strictly prohibited at all New York airports including JFK, LaGuardia, and Newark under federal jurisdiction. Out-of-state visitors 21 and over may purchase and possess cannabis under the same adult-use limits as New York residents.

The New York Office of Cannabis Management oversees all licensing, compliance, and enforcement for both the adult-use and medical cannabis markets statewide.
