Possession
Adults 21+ may legally possess up to 1 ounce of cannabis flower, 12 grams of concentrate, or 750 milligrams of THC in edibles or other products. All possession must be in original packaging. Possession beyond legal limits carries criminal penalties. Public consumption remains a misdemeanor — pending legislation in 2026 proposes downgrading it to a civil fine.
EMPLOYMENT
Your Job
Delaware employers may conduct workplace drug testing and prohibit cannabis impairment on the job. Medical marijuana cardholders are protected from discrimination based solely on their cardholder status or a positive test result. No broad off-duty protections exist for recreational users — employers may still terminate for positive tests under a drug-free workplace policy.
USAGE
Where You Can Use It
Cannabis consumption is permitted only in private residences. Public consumption — including streets, parks, vehicles, and beaches — is currently a misdemeanor in Delaware. A 2026 bill (HB 252) proposes reducing public consumption to a civil fine of up to $50. There are no licensed on-site consumption lounges currently operating in Delaware.
DRIVING
Driving
Delaware has a zero tolerance per se drugged driving law for cannabis and cannabis metabolites. Any detectable amount of THC or its metabolites in a driver's system is grounds for a DUI — the same penalties apply as alcohol DUI. Cannabis was found in 22.7% of Delaware DUI drug cases in FY 2024. Penalties include fines, license suspension, and jail time.
TRAVELING
Traveling
Transporting cannabis across state lines is federally illegal and explicitly prohibited under Delaware law. Cannabis may not be taken through Philadelphia International Airport or any Delaware-area airport — TSA operates under federal jurisdiction. Cannabis must be kept in original sealed packaging and stored out of driver reach while in a vehicle within Delaware.
