MEDICAL ONLY
West Virginia operates a licensed medical cannabis program established under the West Virginia Medical Cannabis Act signed into law in April 2017 — one of the earlier Southern states to establish a medical program. Dispensary operations launched in 2021 following extended delays in regulatory implementation. Recreational use remains fully illegal with significant criminal penalties. The West Virginia Office of Medical Cannabis oversees all patient registration, physician certification, and dispensary licensing statewide.

Registered West Virginia medical cannabis patients may legally possess up to a 30-day supply of cannabis as recommended by their certifying physician. Adult-use possession for non-registered individuals remains a criminal offense — possession of any amount is a misdemeanor carrying up to 90 days in jail and a $1,000 fine for a first offense. Subsequent offenses carry felony charges. West Virginia has no decriminalization provisions at the state level and no municipal ordinances reducing penalties. Driving under the influence of cannabis is illegal in West Virginia. The state enforces a zero-tolerance per se standard — any detectable amount of THC in a driver's blood is prosecutable as a DUI under West Virginia Code § 17C-5-2. Law enforcement uses field sobriety testing and blood draws to establish per se violations. A first DUI offense carries fines of $100–$500, license revocation of 6 months, and up to 6 months in jail. Medical cannabis registration provides absolutely no protection against DUI charges in West Virginia.
TRAVELING

West Virginia borders Ohio to the northwest — a legal adult-use state — making that border corridor an active enforcement zone for cannabis transport. Virginia to the east has a legal adult-use market but crossing any state line with cannabis remains a federal felony regardless of origin. West Virginia medical cannabis patients may not transport their medicine across any state line. All medical cannabis must be sourced exclusively within West Virginia's licensed dispensary network within state borders. Out-of-state medical cards are not recognized in West Virginia.
